El Tribunal Europeo de Derechos Humanos en esta decisión, de 12 de enero de 2010, confirma la necesidad de tomar en consideración los vínculos familiares y sociales de un extranjero antes de proceder a su expulsión. Reitera que las expulsiones deben limitarse a motivos de protección de la seguridad nacional y del orden público. Además. valora negativamente la falta de vínculos con el país cuya nacionalidad detenta el ciudadano que se pretende expulsar.

En todo caso, debe tenerse en cuenta la afirmación hecha por el TEDH: “In light of the above, having particular regard to the length of time that the applicant has been in the United Kingdom and his very young age at the time of his entry, the lack of any continuing ties to Pakistan, the strength of his ties with the United Kingdom, and the fact that the applicant has not reoffended following his release from prison in 2006, the Court finds that the applicant’s deportation from the United Kingdom would not be proportionate to the legitimate aim pursued and would therefore not be necessary in a democratic society”.
